Vipul is an experienced Property Litigation specialist.

His practice encompasses all areas of Property Litigation, with a particular emphasis on commercial landlord and tenant work, including:

Additionally, Vipul advises on general land law matters such as boundaries, derogation from grant, easements, nuisance, and trespass. He also specialises in telecommunications work.

Vipul has acted for a varied client base which includes institutional landlords, offshore landlords, developers, property managers, investors, global and national companies, independent businesses and land owners, high-net individuals, professionals and entrepreneurs.

He strives to deliver practical and cost-effective advice and recognises the need to try and resolve disputes at an early stage, amicably and proportionately. However, where necessary, he acts on all stages of litigation through to trial.

He has also contributed to newsletters and publications, including those which have been published in the Property Law Journal (November 2017: “To Repair or Replace”) and on Lexis Nexis (February 2019: “The FTT’s Pilot Scheme - A Brave New World”).

Experience Highlights

Although Vipul has acted for a varied client base (from large companies to private individual) some highlights include:

  • Advising landlords on their redevelopment strategy, including obtaining vacant possession to redevelop shopping centres in the Midlands and in London.
  • Advising a landlord on vacant possession and redevelopment strategy for the conversion of office premises to luxury apartments.
  • Advising a landlord on obtaining redevelopment break clauses in various leases to facilitate the redevelopment of a prominent retail park.
  • Advising tenants on exercising break clauses to terminate their leases, including preparing and serving notices, advising on pre-conditions and exit-strategy.
  • Advising landlords and tenants in relation to opposed and unopposed business lease renewals of shopping centres, high street portfolios and individual buildings.
  • Advising the landlord of an iconic building in Central London on a dispute with its restaurant tenant regarding claims in nuisance and damages for disrepair.
  • Acting for landlords in forfeiture proceedings where tenants were embroiled in financial fraud and following a fatal shooting at a nightclub in London.
  • Obtaining possession orders against squatters, including a group of political activists.
  • Advising a property investor on the removal of a restriction from his freehold title.
  • Advising a high-net individual on his property re-financing strategy following the secured lender’s threats to enforce its charge.
  • Advising landowners for claims against them by leading telecommunications companies under the Electronic Communications Code.
  • Advising a renowned restaurant in relation to a dispute against its landlord for derogation of grant following the landlord’s works to its nearby premises.
  • Advising a client in a high value dilapidations claim and seeking to minimise that claim on redevelopment grounds.
