Alban specialises in Property Litigation acting for freeholders, leaseholders and management companies in both commercial and residential disputes. He is regularly instructed in Small Claims, Fast, Intermate and Multi-Track litigation cases in the County Courts, High Court and the Tribunals.

Experience Highlights

Alban has considerable experience in LTA 1954 lease renewal applications, CPR 55 possession proceedings and section 27A LTA 1985 applications. Alban also helps maintain client property portfolios including assisting in contentious and non-contentious matters in relation to the same.

Notable cases

  • A & Others v R Ltd – led by David Lewis KC, acted as instructing solicitor for the Respondent in an application by the Claimants for their removal and the appointment of a managing agent under section 24 of the Landlord and Tenant Act 1987. Following a 3 day trial, the Tribunal found that it was not convenient to appoint a new managing agent.
  • Mr. G v A London Borough Council – acted for the Claimant in a successful application for a lease renewal pursuant to Part II of the Landlord and Tenant Act 1954 and immediate assignment of the new lease.
  • RS Ltd v FF Ltd – acted for the Defendant in a number of claims brought by the Landlord Claimant to (1) forfeit the lease for non-payment of rent, (2) forfeit the lease pursuant to section 146 of the Landlord and Tenant Act 1925 for breach of Tenant’s covenants, and (3) trespass on the basis that the Defendant only held a tenancy-at-will.
  • R(H) Ltd v MW and RVH Limited – acted for the 1st Defendant in a dispute concerning beneficial ownership of a large housing development plot worth £17 million. After 3 and half years and several interlocutory applications the matter was settled before trial whereby the 1st Defendant accepted a buyout of his interest in the plot.
